Rental Terms and Conditions

To comply with insurance regulations, guests will be required to agree to the terms and conditions of the rental. The text of the current agreement is shown below. The home you rented is managed by Bretton Woods Vacations, the White Mountains’ premier vacation rental company. While we have grown to well over 100 rental properties, we are still a small business with a friendly team who will go above and beyond to ensure you have a wonderful stay.

We believe vacation rentals bring significant benefits to the local economy and can be part of a healthy neighborhood. The ability to have vacation rentals, however, is under constant attack — and we need to do what we can to preserve the ability to serve you and the thousands of wonderful guests who choose to visit one of our homes each year. As part of that effort, we need to make sure there is a clear understanding of the house rules, and we ask that you ensure they are communicated to all guests in your party.

One final note: as with all homes — ones you own and ones you rent — things sometimes go wrong. Our team does their best to prevent issues, but sometimes things happen. If something is not as it should be, please let us know ASAP so we can address it promptly. And under all circumstances… please be kind. Respect and kindness go a long way.

NON-REFUNDABLE PERIOD NOTICE

This reservation is partially refundable from 30 to 14 days prior to check-in and becomes completely non-refundable beginning 14 days prior to check-in, regardless of whether the Guest later disagrees with, objects to, or fails to review the Rental Agreement, Terms & Conditions, or House Rules.

The opportunity to decline the Agreement by notifying {companies.name} within 24 hours of receipt does not extend, pause, or override the non-refundable or partially refundable cancellation window once that window has begun. Cancellations made outside of the free cancellation window are subject to penalty under all circumstances. Guests who proceed with the reservation inside the non-refundable period accept that no refunds will be issued for any reason, except where required by law.

IMPORTANT: ACCESS CODES / ACCEPTANCE OF TERMS

Access codes are generally delivered via email/text and/or our Digital Guestbook approximately 1 hour prior to check-in. This reservation is governed by this Rental Agreement, Terms & Conditions, and House Rules presented to you prior to booking. If you do not agree with any term, you must notify Bretton Woods Vacations within 24 hours of receiving this Agreement and within the refundable cancellation period. Once the reservation is within 30  days of check-in, cancellation is only partially refundable and once it is within 14 days of check-in it is non-refundable regardless of objection. 

By checking in, entering the property, using an access code, or otherwise taking occupancy, you acknowledge that you have read, understand, and agree to these terms (including the cancellation policy), whether or not an electronic signature is completed.

If you booked through a third-party channel (Airbnb/VRBO/Booking.com, etc.), you may also be subject to that channel’s additional terms and conditions.

Renter requirements

You must be 18 or older to book. If you are not, please let us know immediately. A responsible adult must be present during each rental. The person who created the booking (and/or signs this agreement) is considered to be the Guest. All other persons involved with the rental are considered to be the Guest’s invitees. The Guest is ultimately responsible for the actions of all invitees.

HOUSE RULES

You are renting a privately owned home in a residential neighborhood. It is of the utmost importance that you treat both the house and the neighborhood with respect and that you leave the property in the same condition as you found it. Please obey all local laws, including traffic and speed limits, and ensure there is never any audible noise outside of the property after 10 pm and before 8 am. The exception is for events explicitly authorized by Bretton Woods Vacations in writing.

Failure to follow house rules may be subject to fines or immediate removal from the property without a refund. If you have any questions about these rules, please contact us.

THE FOLLOWING HOUSE RULES ARE EXTREMELY IMPORTANT. SOME ASSOCIATIONS HAVE BANNED RENTALS BECAUSE RULES WEREN’T FOLLOWED! IT IS EXTREMELY IMPORTANT THAT THEY ARE FOLLOWED AND FINES WILL BE IMPOSED FOR VIOLATIONS. PLEASE CONTACT US IF YOU HAVE ANY CONCERNS!

In addition:

  • Guest agrees not to make this home their permanent residence, and to maintain primary residence elsewhere

  • Guest agrees to abide by parking restrictions

  • Emotional Support Animals are subject to the same rules and fees as pets

  • Guest agrees not to perform any criminal activity on the premises, including the use of the home’s internet access for illegal activities

  • Parking violations subject to a $100/vehicle/day fee plus any additional fines imposed by the town or association. Guest agrees that these may be charged to the payment method on file. 

NUMBER OF GUESTS AND MAX OCCUPANCY

The maximum number of people authorized to stay at the property is what you declared at the time of booking. This number can be changed at any time by contacting our team. Please note that changes in occupancy may result in a price change, because rate and cleaning fees are based on an average number of guests, not the maximum number the property can hold.

Please let us know immediately if the number of people in your group changes, or if you have daytime visitors. The rental is not intended for parties or gatherings of anyone except those who have paid to occupy the property. Exceptions are made on an individual basis and may require additional fees — please contact {companies.name} for prior approval.

Occupancy violations, repeated noise complaints and especially unauthorized events may subject you to immediate removal from the property without any refunds.

PAYMENTS 

Payments are subject to the payment schedule set upon booking and, for bookings made anywhere other than our own website or through our staff (direct bookings), dependent upon the booking channel’s policies. The current payment schedule for direct bookings is $1 due at booking, and the remainder due 30 days prior to check-in. If a guest does not submit any balances or make alternative arrangements for payments by the date due, said balances will be automatically charged to the payment method on file.

Should the guest have any concerns regarding a payment, guest must contact Bretton Woods Vacations prior to initiating any credit card disputes. Please understand that our policies are firm, and credit card disputes are not a way around them and may result in overdue accounts being sent to collections and reported to credit bureaus or the Coos County Small Claims Court. Trip Insurance is the only way to recover funds in case of an issue preventing travel. Credit card chargebacks that are reversed by the processor will be assessed a $100 fee per incident to cover dispute-related costs.

DAMAGE POLICY

As a condition of the rental, {companies.name} reserves the right to charge the Guest’s payment method on file for any and all uncovered Guest/invitee-caused losses and damages sustained to the vacation property throughout the duration of occupancy, including any fines assessed by a homeowner’s association, law enforcement, or other government body. In the event of any uncovered loss or damage to the vacation property (including, but not limited to, undue cleaning, eviction, service calls, service charges, fines/assessments, repairs or replacements, plus all applicable taxes), {companies.name} is hereby granted the right to charge the Guest’s payment method on file.

By checking in, entering the property, using an access code, or otherwise taking occupancy of the property, the Guest authorizes these charges and agrees to pay them as described in this Agreement

Please note: 

  • Towels, sheets, pillows and blankets are not meant for outside use or make-up removal. Guest will be responsible for any damage to these items, including excessive staining.
  • Smoking is not permitted in any {companies.name} property.  If there is any tobacco or marijuana smell in the cabin after your departure, you will be charged a $300 cleaning fee. Oil lamps and incense are not permitted due to the long-lasting odor. If these policies are violated, there will be a charge for excessive cleaning.
  • Do not put any feminine products in the toilet. Plungers are provided if a clog occurs. Please do not pour grease down the drain. The cost for fixing any issues arising from guest(s) carelessness will be the Guest’s responsibility. 
  • When you rent the vacation rental, you assume responsibility for it and its contents, as well as your personal property. Always lock the doors and windows when you leave the vacation rental. {companies.name} does not assume any responsibility for injuries resulting from your failure to use due caution. Children must be supervised at all times. Candles are not allowed due to fire hazard. Per NH State Law, no open flames (including charcoal grills) are allowed near any building housing 3 or more units. 

Upon arrival…
If there are concerns or issues with your rental property, please immediately contact our office (leave a message or text us if there is no answer). Our first goal is to ensure you have a great stay, and if anything goes wrong, we ask that we be given a chance to rectify. No refunds or considerations are given unless we are notified of problems DURING your stay and our staff is given an opportunity to address these concerns or rectify any issues.

CHECK-IN/CHECK-OUT TIMES

Arrival time: Check-in is at {reservations.check_in_time}. Early arrival may be arranged based on availability and housekeeping schedule. Fees apply.


Departure time: Check out is at {reservations.check_out_time}. Late departures may be arranged based on availability; fees may apply. If you have not arranged for a late checkout, you may be charged a $100 fee for each hour beyond 11 am, minimum one hour. If the home has not been vacated by 8 pm, a fee equal to the rental rate of one day may be assessed.

Right of entry: 

Guest agrees that {companies.name} reserves the right to enter the rental property at reasonable times and upon reasonable notice when practicable, to investigate disturbances, verify occupancy, address maintenance or safety issues, make necessary repairs, and perform landscaping or snow removal.

In the event of an emergency, suspected violation of this Agreement, or where immediate action is reasonably necessary to protect persons or property, entry may occur without prior notice.

COMMUNICATIONS
To maximize your comfort during your stay, we may send important information via email and text message (including check-in instructions, property updates, etc.). By providing your mobile number and proceeding with this reservation, you consent to receive SMS messages related to your stay. If you wish to opt out, please notify our team. 

CANCELLATIONS
Please note that we have relaxed our cancellation policies, but they will be followed strictly with no exceptions! In addition, Bretton Woods Vacations does not issue refunds due to acts of nature such as: weather, road conditions, snow conditions, ski resort or other attraction closures, floods, power outages or forest fires. Please ensure you have adequate Trip Insurance for your needs in the case of such unforeseen circumstances, including illness of any kind. For third party bookings, the third party cancellation policy shall prevail. Otherwise, for direct bookings, our current cancellation policy is:

  • Free cancellations if cancelled more than 30 days prior to check-in
  • 50% penalty from 30 up to 14 days prior to check-in
  • No refunds within 14 days of check-in

Disagreement with or objection to the Rental Agreement, House Rules, or Terms & Conditions does not constitute grounds for a refund once the reservation is within the non-refundable cancellation period.

– Please note that any third party booking fees (eg, VRBO, AirBnB, etc) are outside of our control and subject to the rules set by the third party. Please refer to the cancellation policy presented at booking by these websites for details, or contact the third party’s customer service if unsure.

These policies are strict and applied fairly to all guests, independent of the reason for cancellation. No exceptions will be granted, including for reasons such as COVID-19 or other illness. For that reason, Trip Insurance is always highly recommended!

Things happen! From travel issues to illness to deaths in the family, a cancellation can be costly, and we MUST abide to the cancellation policy strictly since we are bound by our own contractual obligations with property owners. But you can protect yourself with Trip Insurance! We have 2 policy types available: 

– Standard: protects up to 100% of traveler’s expenses for all covered trip cancellation or interruption reasons listed in the policy documents, including an illness or injury to someone in your traveling party, death in the family, hurricanes, mandatory evacuations, and many more benefits. Can be purchased at time of booking or up to 30 days prior to the start date. If booking within 30 days of start date, can be purchased at time of booking or up to 5 days after booking. Cannot be purchased on the same day as the trip start date

 – Cancel for Any Reason (CFAR): protects up to 100% of traveler’s expenses for all covered trip cancellation or interruption reasons listed in the policy documents. These would be instances such as an illness or injury to someone in your traveling party, death in the family, hurricanes, mandatory evacuations, and many more benefits (OR) up to 60% of traveler’s expenses for trip cancellation reasons NOT listed in the policy Only available to US and Canadian residents (Not available to residents of NY, WA, Puerto Rico, US Virgin Islands, or residents of Quebec). Must be purchased at time of booking or within 14 days of booking if more than 30 days from the trip start date. Cannot be purchased within 30 days of the trip start date. Must cancel the reservation at least 48 hours prior to the start date if filing a claim

 Would you like to add trip insurance to your rental? Please note – if you already selected insurance during check-out, this will override your choice if within the 10 day grace period. No changes to Trip Insurance can be made after 10 days.

Furthermore, it is understood that all homes are subject to events, malfunctions, or breakdowns which may make part of the home or its amenities unusable. Such situations will be dealt with fairly and consistently, in strict compliance with the policies outlined in our Policies page (www.BrettonWoodsVacations.com/policies). These policies are at the Company’s discretion and subject to change with no warning. In addition, we may under some rare and exceptional circumstances be forced to move a reservation to a comparable unit or cancel a reservation with a full refund, due to unforeseen circumstances such as a catastrophic damage or the sale of a property. 
  

SOME MORE LEGAL STUFF: INDEMNIFICATION AND HOLD HARMLESS

While {companies.name} and its property owners strive to maintain vacation properties in the finest condition, no guarantees are expressed nor implied regarding suitability for any particular purpose. All guests and their invitees use the vacation property, structures, and premises at their own risk.

{companies.name} and its property owners shall not be held liable or otherwise responsible for injury to any guest or invitee caused or permitted to be caused by the intentional or unintentional acts of guests or invitees, or by the failure of structures, appliances (including hot tubs and grills), furnishings, or other equipment, whether by malfunction, misuse, acts of God/nature, or otherwise naturally occurring.

No guarantees are expressed or implied regarding the suitability of utilities, services, materials, or contents of the vacation property. {companies.name} and its property owners shall not be held liable for allergic reactions caused by materials, mold, airborne spores, pet/animal allergens, or chemical agents including, but not limited to, appliances, linens, carpeting, utensils, fixtures, hot tubs, pools, or other equipment.

By checking in, entering the property, using any amenity, using an access code, or otherwise taking occupancy of the property, the Guest and all invitees agree to indemnify, defend, and hold harmless {companies.name} and its property owners from and against all claims, demands, losses, liabilities, and costs (including attorneys’ fees) arising out of or related to the Guest’s or invitees’ use or occupancy of the property.

RELEASE & WAIVER OF LIABILITY AND INDEMNITY AGREEMENT

(ICE SKATING, SAUNAS, HOT TUBS, POOLS — IF APPLICABLE)

Some homes are equipped with amenities such as ice skating rinks, saunas, hot tubs, and/or pools (“Activities”). Participation in these Activities involves inherent risks.

By entering the area of any such amenity, using the amenity, or remaining on the premises where the amenity is located, the Guest and all invitees acknowledge and accept all risks associated with participation, whether known or unknown.

The Guest and their personal representatives, heirs, assigns, guests, children, and invitees voluntarily waive and release Bretton Woods Vacations and its affiliates, owners, managers, members, agents, staff, volunteers, successors, and assigns (“Releasees”) from any and all claims for injury, illness, disability, death, or property damage arising from participation in any Activity, whether caused by negligence or otherwise, to the fullest extent permitted by New Hampshire law.

The Guest acknowledges that:

  • They are voluntarily participating at their own risk

  • They have inspected the area and deem it reasonably safe

  • They will immediately leave the area and notify management if any condition appears unsafe

Guest acknowledges that they are voluntarily participating in the Activity and they are participating entirely at my own risk. HOT TUB RISKS which may include but are not limited to drowning, heat exhaustion, heat stroke, skin/ear/bladder/lung or other infections, chemical burns or irritations, physical/psychological injury, pain, suffering, illness, disfigurement, disability, economic or emotional loss, paralysis or death. Guest assumes all related risks, both known and unknown to them, of their participation in this activity. Some of the known risks and precautions include: Pregnant women, children and those with heart disease ARE NOT ALLOWED IN HOT TUBS. Children are NOT ALLOWED IN POOLS unless properly supervised by an adult.  If you are taking medication of any kind, or being treated for diabetes, low or high blood pressure, strokes, epilepsy, weakened immune system or other conditions, or are a frail elderly person, consult your physician prior to use of the hot tub.  It is advised to limit your soak in the hot tub to no more than 15 minutes at a time. If you overheat and faint, you can drown.  Shower before use, and when you get out to rinse off the hot tub and pool chemicals. Keep your head, arms and upper chest out of the water to avoid overheating. Get out if you feel dizzy, overheated, nauseous, or unwell.  Stay hydrated before getting into the hot tub. DO NOT DRINK ALCOHOL or USE DRUGS before or during hot tub or pool use. Please KEEP the hot tub and pool CLEAN and CLEAR: Shower before you get in to get off most particles, oils, cosmetics and hair and skin products. No shoes, street clothes, pets or glass containers in or around the hot tub. Do not eat, or drink, or use soap and shampoo while INSIDE the hot tub. Do not urinate or spit into tub.  Don’t get in tub or pool if you have open sores or wounds, or cuts, or diarrhea.  Close the lid when you are finished.    Do Not sit, lay or stand on the hot tub cover – it will collapse into the hot tub.    Be careful when getting out so you don’t slip and fall. 

Guests are financially responsible for any damage caused by misuse, including but not limited to:

1. Broken covers
2. Contaminated water from oils, lotions, or food
3. Excessive cleaning due to prohibited items
4. Damage from glass, pets, or unsafe behavior

Careless behavior that may necessitate a dump and fill of the hot tub beyond the regular maintenance schedule will result in a maintenance charge of $110.

USAGE OF FIREPITS (WHEN APPLICABLE): Fires are only allowed in any provided firepits, if available. Guest will receive a separate email with information on permits and firewood purchase. Guests choosing to use this amenity are subject to all rules set by the state and take full responsibility for any damages arising from improper use, including property damage to property of another; payment of suppression costs to the town prosecution for failure to comply with regulations. The regulations state the following: I understand the only material allowed to be burned is untreated wood no greater than 5 inches in diameter, untreated pallets, brush and leaves. I understand that a Category I fire (a small controlled campfire no greater than 2 feet in diameter) will be at least 25 feet from structures and that Category II fires (a controlled campfire no greater than 4 feet in diameter) and Category III fires (a controlled fire, such as a brush pile) will be at least 50 feet from structures. The provided firepits are the only place where an outdoor fire can be started. I understand that a Category I fire may be kindled with a permit at any time whether raining or not.  The NH Department of Environmental Services regulations must be followed regarding outdoor burning. I understand that no person shall kindle a fire with or allow the open burning of combustible domestic waste, tires, tubes, stumps, construction and demolition debris, or any other material other than untreated wood no greater than 5 inches in diameter, untreated pallets, campfire wood, brush or leaves. I shall have sufficient water, tools and personnel necessary to control and completely extinguish the fire. I understand that a buried fire is not an extinguished fire. I understand that the fire must be attended at all times. I will remain on the same property as the fire, will have the fire in plain view and will be capable of extinguishing the fire. I am at least 18 years old. I understand that RSA 227-L:2,IV(a) authorizes fire personnel to enter onto my property to inspect my fire location.

ACCEPTANCE AND ENFORCEABILITY

This Agreement, including all indemnification, waiver, and release provisions, is binding whether or not it is electronically signed.

By checking in, entering the property, using an access code, using any amenity, or otherwise taking occupancy, the Guest and all invitees acknowledge that they have read, understand, and agree to all terms, releases, and waivers contained herein.

Transient Occupancy Only; No Lease or Tenancy Rights
The parties expressly agree that this is a short-term vacation rental for transient occupancy only. This Agreement is not a lease and does not create any tenancy, residency, or other property interest.

Guest waives any claim to rights under landlord-tenant laws, including but not limited to eviction protections, notice requirements, or continued possession beyond the reservation term.

Any holdover or unauthorized occupancy shall be deemed trespass.
