The home you rented is managed by Bretton Woods Vacations, the White Mountains’ premier vacation rental company. While we have grown to well over 100 rental properties, we are still a small business with a friendly team who will go above and beyond to ensure you have a wonderful stay.

We believe vacation rentals bring significant benefits to the local economy, and can be part of a healthy neighborhood. The ability to have vacation rentals, however, is under constant attack – and we need to do what we can to preserve the ability to serve you and the thousands of wonderful guests who choose to visit one of our homes each year. As part of that effort, we need to make sure that there is a clear understanding of the house rules and we ask that you make sure they are properly communicated to all guests in your party. In addition, many of the insurance company that our property owners work with require that we receive a signed Rental Agreement before we can let guests use the property. So… here we go! We promise to keep it as straight forward as possible!

Please be advised that the system will not send you an access code for the property until a signed rental agreement is in place! Otherwise, access codes will be received via email 3 days prior to your check-in date. Rental agreements are required independently of where you booked from, but please be advised that if you booked from a third party channel, you may be subject to the channel’s additional Terms and Conditions. 

 

Renter requirements
You must be 18 or older to book. If you are not, please let us know immediately! A responsible adult needs to be present during each rental. The person who created the booking and signed this document is considered to be the guest. All other persons involved with the rental are considered to be the guest’s invitees, and all discussion regarding reservation, cancellation, and damage policies will be discussed with the guest, not the guest’s invitees. Please note that as the guest, you are ultimately responsible for the action of all of your invitees! HOUSE RULES
You are renting a privately owned home in a residential neighborhood. It is of the outmost important that you treat both the house and the neighborhood with respect and that you leave the property in the same conditions you found it. Please obey all local laws, including traffic and speed limits, and make sure there is never any audible noise outside of the property after 10 pm and before 8 am. The only exception for this rule is for events that have been explicitly authorized by Bretton Woods Vacations. Guest and all traveling companions agree to the following house rules. Failure to follow house rules may be subject to fines or immediate termination of lease without refunds. If you have any questions about any of these rules, please do not hesitate to contact us! Please make sure you pay attention to these rules! We want you to have a good time, but failure to follow them may result in fines and, in worst cases, immediate removal from the property with no refunds! And nobody wants that… House Rules:

– Guest agrees not to make this home their permanent residence, and to maintain primary residence elsewhere
– Emotional Support Animals must be declared and subject to all the same rules and fees as pets
– Guest agrees not to perform any criminal activity on the premises; this includes the usage of the home’s internet access for illegal activities.NUMBER OF GUESTS AND MAX OCCUPANCY
The maximum number of people authorized to stay at the property is what you declared at the time of booking. This number can be changed at any time by contacting our team. Please note that change in the number of occupants may result in a change in price, because rate and cleaning fee are based on an average number of guests, not the maximum number of guests the property can hold. This is to keep our homes as affordable as we can while covering the extra costs associated with higher occupancies (extra linen rentals, extra cleaning, extra utilities, and extra wear and tear). These additional guest fees are fair and nominal, but important to be able to provide homes for larger groups while keeping rates affordable for others. 

Please let us know immediately if the number of people in your group changes, or if you have daytime visitors. The rental is not intended for parties, nor gatherings at any time of anyone except those who have paid to occupy the property. Exceptions are made on an individual basis – and we do have homes that are appropriate for parties, but PLEASE contact {companies.name} for prior approval and to discuss!

Occupancy violations, repeated noise complaints and especially unauthorized events may subject you to immediate removal from the property without any refunds.

PAYMENTS
Payments are subject to the payment schedule set upon booking and, for bookings made anywhere other than our own website or through our staff (direct bookings) dependent upon the channel’s policies. The current payment schedule for direct bookings is $1 due at booking, and the remainder due 30 days prior to check-in. If a guest does not submit any balances or make alternative arrangement for payments by the date due, said balances will be automatically charged to the payment method on file. Guests are responsible for any balances and any fees associated with bounced or returned payments. 

Should the guest have any concerns regarding a payment, guest is to contact Bretton Woods Vacations prior to initiating any credit card disputes. Guest agrees that credit card disputes will be assessed a $25 fee per incident. 

DAMAGE POLICY
Please treat the home as if it were yours! As a condition to the rental of all vacation properties, {companies.name} reserves the right to charge the guest’s credit card for any and all uncovered guest/invitee caused losses and damages sustained to the vacation property throughout the duration of their period of occupancy, including any fines assessed by a homeowner’s association, law enforcement or other government body. In the event of any uncovered guest/invitee-caused loss or damage to the vacation property, including, but not limited to, undue cleaning, eviction, service calls, service charges, fines/assessments, repairs or replacements, plus all applicable taxes, {companies.name} is hereby granted the right to charge the guest’s credit card. By written or electronic endorsement of this agreement, the guest hereby agrees to pay for all such charges, as defined above and on the proceeding pages.

Please note:

  • Towels, sheets, pillows and blankets are not meant for outside use or make-up removal. Guest will be responsible for any damage to these items, including excessive staining.
  • Smoking is not permitted in any {companies.name} property.  If there is any tobacco or marijuana smell in the cabin after your departure, you will be charged a $300 cleaning fee. Oil lamps and incense are not permitted due to the long-lasting odor. If these policies are violated, there will be a charge for excessive cleaning.
  • Do not put any feminine products in the toilet. Plungers are provided if a clog occurs. Please do not pour grease down the drain. The cost for fixing any issues arising from guest(s) carelessness will be the Guest’s responsibility. 
  • When you rent the vacation rental, you assume responsibility for it and its contents, as well as your personal property. Always lock the doors and windows when you leave the vacation rental. {companies.name} does not assume any responsibility for injuries resulting from your failure to use due caution. Children must be supervised at all times. Candles are not allowed due to fire hazard. Per NH State Law, no open flames (including charcoal grills) are allowed near any building housing 3 or more units. 

Upon arrival…
If there are concerns or issues with your rental property, please immediately contact our office (leave a message if there is no answer). Our first goal is to ensure you have a great stay, and if anything goes wrong, we ask that we be given a chance to rectify. No refunds or considerations are given unless we are notified of problems DURING your stay and our staff is given an opportunity to address these concerns or rectify any issues.

CHECK-IN/CHECK-OUT TIMES

Arrival time
Check in is at {reservations.check_in_time}. An early arrival may be arranged, pending other reservations and the housekeeping schedule. Please contact us prior to your arrival to make these arrangements. Fees may apply.  Unless you have specifically arranged for an early arrival time, please do not arrive at the property before your schedule check in time.

Departure time
Check out is at {reservations.check_out_time}. Your prompt departure is appreciated so we can prepare the vacation rental for any incoming guests. A late departure may be arranged, pending other reservations and the housekeeping schedule. fees may apply. If you have not arranged for a late check out, you may be charged a $100 fee for each hour beyond 11 am you are still on property, at a minimum of one hour. {companies.name} is hereby granted the right to charge the guest’s credit card accordingly. If the home has not been vacated by 8 pm, a fee equal to the rental rate of one day may be assessed.

Right of entry
Guest(s) agree that {companies.name} reserves the right to enter the rental property any time to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements as we may deem appropriate, or for snow removal.

COMMUNICATIONS
To maximize your comfort during your stay, we will be sending you important information via email and text messages. This includes a notification when the house is ready for check-in, check-in instructions, etc. By signing this agreement, you agree to receive SMS text messages from us. Should you wish to opt-out, please let our team know so that they can remove your phone number from the system! 

CANCELLATIONS
Please note that we have relaxed our cancellation policies, but they will be followed strictly with no exceptions! In addition, Bretton Woods Vacations does not issue refunds due to acts of nature such as: weather, road conditions, snow conditions, ski resort or other attraction closures, floods, power outages or forest fires. Please ensure you have adequate Trip Insurance for your needs in the case of such unforeseen circumstances, including illness of any kind. For third party bookings, the third party cancellation policy shall prevail. Otherwise, for direct bookings, our current cancellation policy is:

  • Free cancellations if cancelled more than 30 days prior to check-in
  • 50% penalty from 30 up to 14 days prior to check-in
  • No refunds within 14 days of check-in

– Please not that any third party booking fees (eg, VRBO, AirBnB, etc) are outside of our control and subject to the rules set by the third party. Please refer to the cancellation policy presented at booking by these websites for details, or contact the third party’s customer service if unsure. 

These policies are strict and applied fairly to all guests, independent of the reason for cancellation. No exceptions will be granted, including for reasons such as COVID-19 or other illness. For that reason, Trip Insurance is always highly recommended! You can purchase Trip Insurance from many online vendors, or directly on our partner website (https://brettonwoods.rentalguardian.com/). Furthermore, it is understood that all homes are subject to events, malfunctions, or breakdowns which may make part of the home or its amenities unusable. Such situations will be dealt with fairly and consistently, in strict compliance with the policies outlined in our Policies page (www.BrettonWoodsVacations.com/policies)

SOME MORE LEGAL STUFF: IDEMNIFICATION AND HOLD HARMLESS
While {companies.name} and its property owners strive to maintain vacation properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All guest(s) and their invitees use the vacation property structures and premises at their own risk. {companies.name} and its property owners shall not be held liable or otherwise responsible in any way for injury to any guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and bbqs) furnishings, and/or other equipment, whether by malfunction, misuse, acts of god/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the vacation properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the vacation property and/or its contents. {companies.name} and its property owners shall not be held liable nor otherwise responsible in any way for allergic reactions to guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the vacation property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this agreement, guest(s) and invitees hereby agree to forever hold-harmless and indemnify {companies.name} and its property owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the guest(s) use of the property.

RELEASE & WAIVER OF LIABILITY AND INDEMNITY AGREEMENT for ICE SKATING, SAUNAS, HOT TUB and POOL USE (if applicable)
Some homes are equipped with ice skating rinks, saunas, hot tubs and/or pools. We think amenities are great and encourage owners to provide as many amenities as possible to make your stay more enjoyable. But of course, with all amenities, there is a risk!  IN CONSIDERATION OF the risk of injury that exists while using said amenities (hereinafter the “Activity”); and IN CONSIDERATION OF the guests’ desire to participate in said Activity and being given the right to participate in same;

The guest, their personal representatives, executors, administrators, assigns, guests, children, heirs, and next of kin knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or causes of action of any kind arising out of their participation in the Activity; and

HEREBY release and forever discharge Bretton Woods Vacations, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns (collectively “Releasees”), from any physical or psychological injury that they may suffer as a result, direct or indirect, of their participation in the Activity.

HEREBY acknowledge that upon entering the ice skating rink, sauna, hot tub or pool area, they will continuously and thoroughly inspect such area. The guest’s or their invitees continued presence constitutes an acknowledgment that they have inspected this area and find and accept such areas as being safe and reasonably suited for the purposes of the Activity. Guest further agree and warrant that if, at any time, they feel or think anything to be unsafe, they will immediately leave the area and advise Bretton Woods Vacations.

Guest acknowledges that they are voluntarily participating in the Activity and they are participating entirely at my own risk. HOT TUB RISKS which may include but are not limited to drowning, heat exhaustion, heat stroke, skin/ear/bladder/lung or other infections, chemical burns or irritations, physical/psychological injury, pain, suffering, illness, disfigurement, disability, economic or emotional loss, paralysis or death. Guest assumes all related risks, both known and unknown to them, of their participation in this activity. Some of the known risks and precautions include:

  • Pregnant women, children and those with heart disease ARE NOT ALLOWED IN HOT TUBS.
  • Children are NOT ALLOWED IN POOLS unless properly supervised by an adult.
  • If you are taking medication of any kind, or being treated for diabetes, low or high blood pressure, strokes, epilepsy, weakened immune system or other conditions, or are a frail elderly person, consult your physician prior to use of the hot tub.
  • It is advised to limit your soak in the hot tub to no more than 15 minutes at a time. If you overheat and faint, you can drown.
  • Shower before use, and when you get out to rinse off the hot tub and pool chemicals.
  • Keep your head, arms and upper chest out of the water to avoid overheating. Get out if you feel dizzy, overheated, nauseous, or unwell.
  • Stay hydrated before getting into the hot tub.
  • DO NOT DRINK ALCOHOL or USE DRUGS before or during hot tub or pool use.
  • Please KEEP the hot tub and pool CLEAN and CLEAR: Shower before you get in to get off most particles, oils, cosmetics and hair and skin products. No shoes, street clothes, pets or glass containers in or around the hot tub. Do not eat, or drink, or use soap and shampoo while INSIDE the hot tub. Do not urinate or spit into tub.
  • Don’t get in tub or pool if you have open sores or wounds, or cuts, or diarrhea.
  • Close the lid when you are finished.
  • Do Not sit, lay or stand on the hot tub cover – it will collapse into the hot tub.
  • Be careful when getting out so you don’t slip and fall.

BY SIGNING THIS AGREEMENT AND VISITING THIS PROPERTY, GUEST ACKNOWLEDGES THE FOLLOWING STATEMENT:

I AGREE to INDEMNIFY, DEFEND AND HOLD HARMLESS the releasees against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney’s fees and any related costs.

I FURTHER ACKNOWLEDGE that Releasees are not responsible for errors, omissions, acts or failures to act of any party or entity involving this Activity on behalf of the Releasees. I further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of medical treatment necessary as a result of the Activity. I am aware and understand that I should carry my own health insurance.
I hereby acknowledge that I have carefully read this “waiver and release” and fully understand that it is a release of liability. I expressly agree to release and discharge Bretton Woods Vacations and their Releasees from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I otherwise have to bring a legal action for personal injury or property damage. To the extent that statute or case laws does not prohibit releases for ordinary negligence, this release is also for such negligence on the part of Bretton Woods Vacations and Releasees.

I agree that this Release shall be governed for all purposes by New Hampshire law, without regard to any conflict of law principles. This Release supersedes any and all previous oral or written promises or other agreements. This waiver and release of liability shall remain in effect for the duration of my participation in the Activity, during this initial and all subsequent events of participation.

In the event that any damage to equipment or facilities occurs as a result of my or my family’s, guests, or agents willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with ay such actions of neglect or recklessness.
In the event that any provision contained within this Release shall be deemed to be severable or invalid, or if any term, condition, phrase or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect.
